Limited Warranty and Return Policy

This Limited Warranty and Returns Policy (“Limited Warranty”) applies to the ENSO Device and ENSO Pads (the “Product”) and is given by Thimble Bioelectronics, Inc. and its subsidiaries and affiliates (collectively, “ENSO”) to the individual or entity (the “Owner”) who purchased the Product from ENSO in the case of warranty. This Limited Warranty applies only within the United States and is not transferable.

30-Day Return Policy If you purchased the Product directly from ENSO, then you may return the Product within 30 days of receiving it. In order for a refund under this Returns Policy to be granted, you must request a Return Merchandise Authorization (RMA) number from ENSO during the 30-day period following the date you received the Product from ENSO. You may request an RMA number by submitting a request at ENSO Customer Support support@ensorelief.com.

If the Product is returned in accordance with this Returns Policy, ENSO will credit the account you used to make the original purchase with the full purchase price you paid for the Product and any applicable taxes minus any shipping and handling charges you paid when you purchased the Product. You are responsible for and must prepay all return shipping charges and you assume all risk of loss or damage to the Product while in transit back to ENSO.

The time to credit your account may vary, depending on processing time. Please allow up to 4 weeks for ENSO to credit the account used to make the original purchase. If you received a damaged Product directly from ENSO, please contact support@ensorelief.com.

Manufacturer’s Limited Warranty
Thimble Bioelectronics, Inc. (“Thimble”) warrants to the original purchaser (“Customer”) that your ENSO device and accessories (the “Product”) will be free from defects in materials and workmanship for a period of one (1) year from the date of shipment (the “Warranty Period”). If a defect in the Product arises within the warranty period, Thimble will, at its sole option and subject to applicable laws: (a) replace the item with a new or refurbished product or accessory; or (b) refund the original purchase price.

HOW TO OBTAIN WARRANTY SERVICE
To obtain Warranty service or replacement, Thimble must receive Customer’s claim within the Warranty Period. Customer must show proof of purchase and obtain a Return Material Authorization (“RMA”) number through contacting customer support prior to returning the Product. Customer is responsible for shipping costs to Thimble. If product is determined to be defective as covered under this Warranty, Thimble will replace the Product and cover cost of shipment back to Customer. Customer understands that they are transferring ownership of the returned Product to Thimble and that Thimble may not be able to return the original Product back to the Customer. Product that is replaced will be covered for the remainder of the original Warranty Period. Any Product that is returned to Thimble without an RMA number or determined not covered under this Warranty may be returned to Customer (at Customer’s expense) or disposed of by Thimble. EXCLUSIONS
This Warranty does not cover damage caused by accident, abuse, misuse, unauthorized modification or disassembly, usage not in accordance with Product instructions, use with components or accessories not supplied by Thimble, or other causes beyond our control. This Warranty does not cover cosmetic damage or normal wear and tear. Additionally, this Warranty does not cover to Products (for example, gel pads) which are past expiration date. Warranty applies to hardware Products only and does not cover software components (e.g., ENSO Relief app).

LIMITATIONS
EXCEPT TO THE EXTENT REQUIRED BY LAW, ALL IMPLIED WARRANTIES (INCLUDING MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE) ARE LIMITED TO THE DURATION OF THIS LIMITED WARRANTY.

EXCEPT TO THE EXTENT REQUIRED BY LAW, THIMBLE SHALL NOT BE LIABLE FOR ANY INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR INDIRECT DAMAGES ARISING FROM THE USE OF THIS PRODUCT, OR IN CONNECTION WITH THIS AGREEMENT RESULTING FROM ANY BREACH OF EXPRESSED OR IMPLIED WARRANTY OR CONDITION, OR UNDER ANY OTHER LEGAL THEORY, EVEN IF THIMBLE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Some jurisdictions do not allow limitations on the duration of an implied warranty, or the exclusion or limitation of incidental, special, consequential, or indirect damages, so the above limitations may not apply to you.

Other Important Notices The rights provided to you under this Limited Warranty are provided in addition to all rights and remedies conveyed to you by consumer protection laws and do not affect your legal (statutory) rights under your applicable national law.

This Limited Warranty is offered subject to ENSO’s Terms and Conditions, which may change from time to time. You can find the latest version on our website at: http://ensorelief.com/terms. In the case of any inconsistencies between the Terms and Conditions and this Limited Warranty, this Limited Warranty will prevail.

This Limited Warranty does not apply to any mobile device or the cellular and/or other network or system on which the Product operates. Therefore, ENSO will not accept any responsibility under this Limited Warranty for the operation, availability, coverage, services or range of the cellular or other network or system.

Always completely follow safety, use, operation, and maintenance instructions for the Product or any other ENSO product as specified in the User Manual.
